Your use of the PortableOne.com website (the "Site") and our services, including phone orders and inquiry, is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. If you do not agree to these terms and conditions, please do not use this site and please do not submit any orders for products or services. The terms and conditions posted on this website, including the RMA policy, are public information and must be adhered to by anyone doing business with Portable One, Inc unless there is a written contract signed by an officer of Portable One, Inc.

Sales Tax

NO SALES TAX collected at time of sale for customers outside of California. Portable One is not required to collect sales tax when shipping outside of CA, MA, and TN. We are required to collect MN Use Tax. Please read below for more information about sales taxes.

PORTABLE ONE, INC SALES AND USE TAX POLICY STATEMENT

We have prepared this sales tax policy statement to explain to you when and why we collect sales tax on your purchases.

IMPORTANT NOTICE: Even if we do not collect sales tax from you, you may owe sales tax on your purchase. Unless you live in Alaska, Delaware, Montana, New Hampshire, or Oregon, your state most likely requires purchasers to report and pay tax on all purchases that are not taxed at the time of sale. The tax may be reported and paid on your individual income tax return or by filing a consumer use tax return. For more information, please visit your state's department of revenue website.

PORTABLE ONE, INC COLLECTS SALES TAX in states where we have physical presence (or nexus), including CA, MA, and TN. Portable One, and Inc also collects sales tax in Minnesota.

PORTABLE ONE, INC DOES NOT COLLECT SALES TAX in any state NOT listed above because Portable One, Inc is not required to collect sales or use tax in these states.

General Terms And Conditions:

  • Portable One, Inc uses the services of third party services who provide product descriptions, images, pricing, etc posted on our website, we do our best to ensure the information on the website as accurate as possible. Customers will agree that we are not liable for omissions or mistakes in product information. Portable One, Inc will only guarantee that we ship the product based on the part number(s) on the invoice.
  • Our sales representatives are forbidden to make any claims on product or services, especially over the phone. Once again, Portable One, Inc can only guarantee that the products named in your invoices will be shipped. Any additional provisions to your purchase must be made in writing.
  • Customers shall agree that each item in a multi-item purchase from Portable One, Inc shall be treated independently unless stated otherwise in the memo section of their order. That is, defect, replacement, and cancellation of one item does not constitute the voiding of the entire purchase. Each item shall be considered independently for warranty or refund purposes unless the customer has stated otherwise in the invoice memo.
  • Customers agree that under absolutely no circumstances will shipping be refunded once we ship. Labor is not refundable once service is performed.
  • It is the customer's responsibility carefully review their email order confirmation and make sure all shipping, billing and items purchased are correct. If you do not get an email confirmation, call us to see if the order was accepted. Do not submit multiple orders or you will end up paying full restocking and shipping fees.
  • Customers agree to report lost or damaged shipping claims to Portable One, Inc within 48 hours of scheduled delivery. Customer agrees to refuse any package from Portable One that does not arrive in acceptable condition. Failure to do so results in the forfeiture of any possible remedy from Portable One, Inc. Portable One shall be responsible for product to be free from loss or damage caused prior to, or during, shipping. Customer agrees to accept full responsibility for product condition once package is signed for.
  • Customers agree to report incorrect or missing products to Portable One, Inc within 48 hours of receipt. Failure to do so results in the forfeiture of any possible remedy from Portable One, Inc.
  • Order cancellation will be accepted by phone with a sales representative or over the web (only before the order is processed). It cannot be done over email or by leaving voice mails. You can confirm order cancellation by checking the order status online. Shipped orders cannot be canceled under any circumstances; A Return Authorization will be required.
  • Material fee for boxes, transportation, etc. are included in the shipping fee with the exception of shipping insurance and calculated on per shipment basis. Customers shall not be liable for additional shipping charges for purchases Portable One, Inc chooses to ship in multiple packages unless they request and agree to shipping upgrades and upgrade fees at time of order.
  • Customers agree that Portable One, Inc will not be liable for shipper's shipping delays. In such cases, customers may petition for a shipping rate adjustment from the shipper if packages do not arrive within the shipping company's promised timeframe but in no way is Portable One, Inc required to do so.

    Customers certify that credit card information provided by customer while ordering, on-line or otherwise, is true, accurate, and appears in the name as stated. Authorization is hereby given to authorize and charge provided credit card for purchases placed with Portable One, Inc. This authorization allows Portable One, Inc. to use this information and such information shall remain in full force and affect unless such is revoked in writing.

    Further, Customers agree to pay any and all customs related fees, assessments, charges, duties, taxes, etc on international shipments. In the event that Portable One, Inc. is later billed, and thusly pays, such fees on Customer’s behalf, Customer agrees to reimburse Portable One, Inc for such payment via the same method used on the original order or other method mutually agreed upon between Customer and Portable One, Inc.

    Apple products are not available to resellers.

Trademarks

Portable One and the Portable One logo are registered trademarks of Portable One Incorporated in the United States and other countries. All other trademarks are the property of their respective owners.

Making Purchases

If you wish to purchase products offered on the site, you will be asked to supply certain information, including but not limited to credit card or other payment information. You agree that all information you provide to Portable One, Inc will be accurate, complete and current. You agree to pay all charges incurred by authorized users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes, and shipping and handling charges relating to your purchases.

All new accounts will be reviewed for approval prior to orders being processed on a new customer account. Due to manufacturer restrictions, some products may not be available for all customer accounts.

Where we Ship To:

We ship to any physical address that UPS or FedEx ships to within the United States. Orders shipping to MA and WA may take an additional 1-3 business days if sales tax isn't paid. We offer shipping to APO/FPO address for our military customers and their families. We do not ship to "Freight Forwarders" or "Drop Shippers".

In order to get your products to you quickly we have strategically located warehouses nationwide allowing us to get your order to you within 1-3 business days when local availability allows. We currently have warehouses in the following states:

When we ship

In stock, standard, and non-customized items usually ship same or next business day from the date of the order. Your order may be delayed if your ship to address does not match what your credit card issuer has on file. We verify all addresses for protection against fraud. We may also ship orders with multiple items from different warehouses so it is possible you will receive your items on different days.If you choose next day air service, it does not necessarily mean you will receive your order the next day from the order date, it means that you will get it the next carrier service day (usually excludes holidays and weekends) from the date it is shipped. Any offer for free shipping may be shipped via ground service if a suitable warehouse can achieve offered delivery time via ground service. Free shipping offers are eligible only within the continental USA. Orders with free shipping will usually be delivered within 5-8 business days. We process and ship free shipping orders in the most cost-efficient way possible so we can pass the savings on to you in the form of free shipping. This means that we’ll optimize our fulfillment operations by taking a little longer to ship out if necessary.

Customized, built to order items, and special services will take longer to deliver depending on the specifics of the order. Portable One performs most upgrades in out integration center in CA. If you select upgraded RAM, SSD, Hard Drive, etc you are ordering a customized laptop and should expect it to usually ship in 3-5 business days from your date of order. We will inform you of any known delays beyond this period. Factory built-to-order laptops can take two to eight weeks to manufacturer and are non-refundable once the order is placed with the manufacturer unless the manufacturer allows the order to be canceled. This is out of the control of Portable One. Customer agrees to these terms for built to order and customized items.

Shipping Delays

Lost Packages: Once an order is shipped, it is up to the carrier to deliver the product. Portable One, Inc will not be able to stop the shipment once it is shipped. If the carrier loses the package, claims must be filed with the carrier. We will not be able to ship a replacement product until or unless the carrier confirms that the package is lost and or will not be delivered to its destination and they will reimburse us.

Signature Requirement: Every package we ship requires a customer signature, if a package is returned to us because no one was available to sign for it or the address was input incorrectly at the time the order was placed, you will be charged again to ship it out a second time.

Weather: Sever weather occasionally causes delays for carriers.

Customizations: Customized products are brought to our integration center for customization prior to shipping. This generally adds 1 to 3 business days for most upgrades. Timeframes for special OS or software installs will vary. These items are clearly identified.

Built to Order Items: Manufacturers such as Panasonic and Itronix manufacturer many of their products on a per-order basis. As such, these items can take from two to eight weeks to manufacture and ship. These items are clearly identified.

Pricing and Typographical Errors

Due to the fast pace of technology, all prices are subject to change without notice. We make every effort to list the most accurate, up to the minute information. Despite our efforts, and although rare, some items on our website may be mispriced. If a product is listed at an incorrect price due to a typographical, photographical, or technical error or error in pricing from our vendors, Portable One, Inc. reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price.

If your credit card has already been charged for the incorrect price, we will immediately refund your card and cancel your order. You may also repurchase it for the correct price if you wish to do so.

Due to the volatility in pricing for technology products, we will not offer price protection beyond 24 hours of the purchase, estimate or price quote unless you obtain a formal quote from us ahead of time specifically stating details of the price protection. An estimate with an expiration date does not constitute price protection.

Order Acceptance Policy

Your receipt of an electronic or phone order confirmation does not signify our acceptance of your order. Portable One, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason.

Price Matching

If you find a better price on any product at another authorized retailer, we will try to meet or beat that price.

  • Complete competitor's price is subject to matching (including any taxes, shipping and handling charges).
  • Competitor must be an authorized dealer (as listed by manufacturer)
  • Product must be in-stock and be brand new merchandise.
  • No other offers or discounts may apply to price match.
  • One time price match applies within the 30 days of purchase.
  • Does not apply to manufacturer promotional pricing outside of order date.

Exclusions: Manufacturer instant rebates or package bundles are not eligible for price matching, as these promotions are available to new purchases only- within the specified promotional time frame. These special offers will not be honored outside of their promotional periods.

Return Policy and Conditions

We offer a 20-day money back guarantee from the original ship date for most merchandise. Certain restrictions apply to the products listed below. Please check through for more detail. After 20 days, only the manufacturer's warranty applies and no returns will be accepted.

A RETURN AUTHORIZATION NUMBER (RA#) must be obtained on-line through your Account history and is required for ALL returns. We reserve the right to charge a 15% restocking fee on returns or exchanges. Merchandise must be returned within 7 calendar days of the issuance of the RA# at which time the RA# expires. RA#'s are non-renewable. To help minimize re-stocking fees, follow the return instructions carefully: include all original equipment and packaging, in like-new condition to minimize these fees.

We reserve the right to return any merchandise without a valid RA# to the customer or to prorate the credit.

All returned merchandise must be in the original packaging with the UPC or bar code intact. All components, manuals, registration card(s), software, cables & accessories must be included. The original retail box must not be damaged or written on. All returned merchandise must be shipped in an appropriate shipping box. Portable One inspects all returns and reserves the right to return merchandise that does not meet the criteria.

To receive full product credit, purchases must be returned with shipping costs pre-paid. Customers are advised to ship approved returns via a major carrier, with insurance and tracking. Portable One is not responsible for lost or damaged returns. All items must be in "AS-NEW" condition, in original packaging, and with all warranty cards, manuals and accessories. Any discrepancies will result in delay or partial forfeiture of your credit.

Special orders, custom built to order products by the manufacturer (e.g., Panasonic, Itronix and Apple products), and discontinued or clearanced products are not eligible for return unless not functioning according to manufacturer specifications (must be reported to Portable One within 48 hours of receipt of product) and are not eligible for cancelation without the manufacturer's approval. Other non-returnable products include Apple iPod, Apple iPad, opened accessories, opened software, products from Panasonic, Getac, and Durabook.

Original shipping costs, services and imaging services, provided with or without charge on the original order, are never refundable.

ASUS products are warrantied by ASUS. This includes any defects, dead pixels, etc.

Software, components, parts, etc are not returnable once opened.

All of Portable One, Inc’s products are guaranteed against manufacturer defects for 30 days from the date of the invoice. EXCEPT AS EXPRESSLY STATED HEREIN, Portable One, Inc. Title Transfer

Portable One, Inc. retains title to parts and complete systems purchased until the said purchaser pays for items in full at which time the title passes to purchaser.

Governing Law

You agree that any legal action brought against Portable One, Inc. shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Portable One, Inc. web site shall be an appropriate federal or state court located in Alameda County, California.

By using the Site, you agree to allow Portable One, Inc. to collect your information in manner in which is consistent with our Privacy Policy and our Terms and Conditions.
